I am very sorry to hear about your accident. I have been asked to try and negotiate a fair settlement for this very unfortunate incident. I have read your letters and would like to reply with some considerations.
Please understand that we are not trying to make money off this unfortunate incident. The only goal is to have our unit replaced with another of similar value and features so we can continue on doing business. I am sure if you were an honest business owner that is all you would expect.
The Blue Book value you quoted was for trade-in value. If you click the retail button, then you will see that the retail value was $16,540 (

This means that there is no guarantee that anybody would sell at that price. For example if there are no other GoldWings available, they can be sold for much higher prices which I will demonstrate shortly. I cannot go to a seller and tell them they have to sell me their GoldWing for Blue Book. Blue Book is only used as a resource for courts and insurance to establish baseline cost. Therefore we only expect Blue Book value even if we have to pay higher price locally. As far as trade-in, if there was a customer that would actually trade in his 2008 GoldWing (with same features) to us for $12,500 we would gladly take it and extend the same deal to you. The issue is we need to go purchase a GoldWing for retail as nobody would ever sell us a unit for that low of price.
I have researched the unit GoldWing for $7,800. He is in the United States. I believe you thought the unit was in Canada which it is not. So immediately that increases with current exchange rates. Then there are shipping charges which the owner is calculating at $2,000-$2,500 plus which will take up to a 30 days to arrive based upon the border. Then we have to pay duty, TAX, legal fees, RIV and more. This puts the price mush higher than you suggest. We have calculated this and to purchase this unit It would in the end cost much more than $16,000. Also note that there is no guarantee that this unit is in proper condition. The seller could be lying (many people lie on the Internet to sell as I am sure you know) and there would be no way to tell if the unit was even working until it arrived in Canada.
The more critical issue here is time. Every weekend that goes by we lose rental revenue which was caused by your accident. The solution is to be able to immediately purchase a unit locally (not in Florida) and start renting it. We have researched and the GoldWings available right now and have found the following:
2008 $18,500 – this has more features but would cost about $1,000 to ship to us since it is in Saskatchewan.

To prove once again that we are not trying to profit from this and only replace our unit, if you are able to find a GoldWing of the same year, value and features as ours and have it delivered to us in the next day, then we will happily accept that and we do not have to have this discussion. We have received a quote from a certified Honda Dealership here that our GoldWing was valued at $16,100 retail when it went out on your rental. This letter is signed and certified by a dealer and can be submitted as evidence in any court case.
As stated earlier we are not trying to make money. This means we are not trying to charge you money and then get money from our insurance as well. Our insurance does not cover the cost of accidents and as stated before only covers third party liability. We do have a third party insurance for collision coverage that is available but this is very expensive which is why there is a high deductible. Would you have rented from us if we charged you a $16,300 deposit? Obviously not. There is also another reason why you had to come to us to rent the GoldWing because there are no other companies that will rent such a unit for the very reasons of risk. This is why we have legal contracts to cover the risk we as a business take by renting you an expensive unit for a damage deposit that is lower than the value of the unit.
It is very unfortunate that a man of your experience and professionalism would resort to wanting to take this to lawyers immediately. I am sure if you properly review the facts above, you will see that any lawyer (and judge) would find our expectations reasonable. If you could kindly please take the time to reconsider your stance and let me know if we can come to a gentleman’s conclusion and settle this in fairness. I would never want any accident to happen to any of our riders so please know I feel terrible we are in this situation.
Again, I strongly suggest you review your legal contract and this email before responding.
Please note that once this is settled, you would in fact own the GoldWing that is damaged. We can then dispose of the unit for you at a reasonable charge or if we can sell it for the metal recycling this would offset disposal fees. I tell you this so you understand that we will not be trying to rebuild the damaged unit to rent to someone else unethically.
